I and Mr. Das are partners of a construction business, the partnership agreement was not registered but was notarised. I invested invested 100% and my partner did not invest any money, which he promised to invest, in turn, he is asking for the share of money as he needs more money. Meanwhile, he has transferred 11,33000/- into his own personal account for making UPI payments to labour contractors and suppliers but has not done any payment from that transferred amount. He took Rs. 500000/- in cash from the office for depositing the same to the firm’s bank account but has not deposited the amount. When asked about the total money of.1633000/- , he kept quiet and left the office and remained absconded from the office, and construction site. He then intimated to the bank manager to debit freeze the account. He then filed caveat against all properties where ongoing pand upcoming projects of our company are going on. With no option left, I lodged a complaint with local police station, followed by another complaint to local P.S.and D.C. office then finally an FIR was lodged from the AJCM. He tried to take anticipatory bail from High Court.which was dismissed by H’ble High Court as he did not come up to the police station for investigation. Now to avoid arrest he is absconding for the last 5 months and the police inspite of several raids have failed to arrest him. Police has recently started using LI to know his whereabouts. Recently one of the flat purchasers has sent me a legal notice as the month for handover of the flat has surpassed and he wants his money back with bank interest. Now I am unable to pay supplier’s and labour contractor their payment which is over due. My partner has kept in his possession all the cash vouchers, bills and bank cheques. Now I am helpless how to move ahead as he is not getting arrested. One of his relative came to me and requested to withdraw the criminal case and told me to give him 40-50 lakhs and he will quit from the partnership firm. As I have no money to pay the suppliers and contractors and also one investor I am clueless. Is there any way I can dissolve the partnership as he is absconding since the FIR has been lodged. Or if I can expel him from the partnership and induct my wife as a new partner as he is absconding for a long time now. There must be some thing in the partnership law which can give me relief.
